Information on the protection and use of personal data in accordance with GDPR 679/2016.


PURPOSE 

The personal data collected will be used exclusively to fulfil your request for explanatory, commercial and promotional information and they will be exclusively kept for the necessary time. With reference to processing for the purpose of sending commercial and promotional communications of its own services, the data will be kept until any request to the contrary is submitted.

DATA PROCESSING METHOD

Carbon Line srl shall process these data in accordance with the instructions of the Data Protection Supervisor under its general authorisation No. 2/2007 and subsequent amendments and additions. In this case, the data subject must give his/her explicit and unequivocal consent using the appropriate form provided upon service activation.

DISCLOSURE AND DISSEMINATION OF DATA

The data shall not be disseminated, sold or exchanged with third parties, unless it is absolutely necessary to meet the data subject’s requests or to comply with technical and operational requirements, closely related to the purposes set out above. In any case, third parties may only use the data in full compliance with the principle of fairness and the provisions of law. The data collected may be disclosed to third countries, i.e. countries outside the European Community. In this case, Carbon Line srl, in addition to requesting the data subject’s explicit consent, shall ensure that these countries have issued a GDPR compliance statement.

THE RIGHTS OF THE DATA SUBJECT

The data subject may exercise his/her rights under Articles 15 - 22 of the GDPR by sending an email to info@elevayachts.com. The right to the request is adequately protected as it must take place at the latest within one month of receipt of the request (extended by two months, if necessary and, in any event, by informing the data subject, taking into account the complexity and number of requests). The controller may demonstrate that it is in a position to charge a reasonable fee taking into account the administrative costs of providing the information or communication. According to Article 15, the data subject shall have the right to obtain from the controller confirmation as to whether or not personal data concerning him/her are being processed, and, where that is the case, access to the personal data and the information on the purposes of their processing, the categories of personal data concerned, the recipients or categories of recipient to whom the personal data have been or will be disclosed, in particular recipients in third countries or international organisations. In any case, all information and communication must be given in a concise, transparent, intelligible and easily accessible form, with simple and clear language, especially in the case of information addressed to children. The information must also be provided in writing by electronic means unless requested orally. The data subject's right is extended to the erasure of his/her personal data, for example when the initial consent is withdrawn, or they are no longer necessary for the purposes for which they were collected/processed, or they have been unlawfully processed. The data subject also has the right to rectify inaccurate personal data concerning him/her, without undue delay; to the limitation of processing (minimisation); the right to be forgotten, whereby the request for erasure of personal data relating to the user must also involve any external processors so that these may cancel any link to such data or their replication; also, the right to data portability, whereby the data subject has the right to transmit those data to another controller without hindrance from the controller to which the personal data have been provided, where the processing is based on consent or on a contract and is carried out by automated means.

RETENTION PERIODS

Carbon Line srl, for purposes strictly related to the service requested, shall retain the user’s personal data for a period of 26 months, after which the data will be automatically erased. With reference to processing for the purpose of sending commercial and promotional communications of its own services, the data will be kept until any request to the contrary is submitted.

In the event of a request for access by the data subject pursuant to Article 15, Carbon Line srl shall comply with the request within and no later than the time limits required by law, referred to above.

CONTROLLER

The controller and processor of the data collected is Carbon Line srl, with registered office at Via Papiria 63, 61032 Fano (PU).

NATURE OF DATA PROVISION AND CONSENT

The provision of data is optional and up to the data subject. However, in the event of failure to provide data, it will not be possible to proceed with the requested service. Consent to the processing of the user’s personal data for marketing purposes is free, specific, informed, verifiable and revocable at any time.
